Judge Delivers Bad News To Biden

A Trump-appointed federal judge has denied the request of the Department of Homeland Security (DHS) to dismiss the lawsuit regarding the catch and release policy of the Biden administration. The policy has notably allowed a large number of illegal immigrants to enter the country since January of last year. 

Judge T. Kent Wetherell II refused the dismissal of the suit stating that laws “clearly and unambiguously state that aliens arriving at the border ‘shall be detained,’ not that they may be detained,” adding that “the cited provisions of §1225 expressly require aliens to be detained until removal proceedings have concluded, and that §1182(d)(5)(A) does not authorize Defendants to circumvent the mandatory detention requirement as it is allegedly doing through the challenged policies.”

Florida Attorney General Ashley Moody brought the suit forth against Biden’s DHS in February. In the lawsuit, it was stated that the agency was surpassing its authority by allowing for the release of illegal aliens and border-crossers into the U.S. This mass release has also put a burden on individual states.

The case is Florida v. the United States, No. 3:21-cv-01066 in the U.S. District Court for the Northern District of Florida.

The release by the Biden administration relates to approximately 836,000 border crossers and illegal aliens who were allowed into the U.S. from February 2021 to March 2022.
